Terms of Service

Welcome to WishPort. These Terms of Service ("Terms") govern your access to and use of the WishPort website, mobile applications, browser extensions, and any related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use WishPort. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these requirements.

2. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately if you suspect unauthorized use of your account

We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

3. The Service

WishPort provides a platform that allows users to:

  • Create and manage wishlists with desired items
  • Import product information from third-party websites via URL
  • Share wishlists with others via unique links or publicly
  • Allow others to anonymously reserve gifts to prevent duplicates
  • Track product prices and receive notifications about price changes
  • Organize gift exchange events (e.g., Secret Santa)
  • Follow other users and view their public wishlists

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

4. User Content

You retain full ownership of all content you create on WishPort, including wishlist names, descriptions, and any manually entered information ("User Content"). By posting User Content, you grant WishPort a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content solely for the purpose of operating and providing the Service.

You are solely responsible for your User Content. You agree not to post content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Infringes on any patent, trademark, trade secret, copyright, or other proprietary right
  • Contains software viruses or any code designed to disrupt or damage the Service
  • Impersonates any person or entity or misrepresents your affiliation

We may remove User Content that violates these Terms at our sole discretion.

5. Third-Party Content and Links

The Service allows you to import product information from third-party websites. This information is extracted automatically and is provided "as-is." WishPort does not guarantee the accuracy, completeness, or availability of any third-party product information, including but not limited to product names, descriptions, images, prices, and availability.

WishPort is not affiliated with, endorsed by, or responsible for any third-party websites or merchants. Product purchases are made directly between you and the merchant, and WishPort is not a party to any such transaction.

6. Price Tracking

WishPort may provide price tracking features that monitor product prices on third-party websites. Price data is obtained through automated means and may not always be accurate or up-to-date. WishPort does not guarantee the accuracy of price information and is not responsible for any purchasing decisions made based on this data.

7. Gift Reservations

The reservation feature allows users viewing a shared wishlist to indicate their intent to purchase a specific item. Reservations are non-binding and do not constitute a purchase agreement. WishPort does not facilitate, process, or guarantee any gift purchases. The wishlist owner cannot see who has reserved specific items.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service or other users' accounts
  • Use automated means (bots, scrapers, spiders) to access the Service without our written permission
  • Interfere with or disrupt the Service or its infrastructure
  • Circumvent any security or rate-limiting measures
  • Use the Service to send spam or unsolicited communications
  • Create multiple accounts to evade restrictions or bans

9. Intellectual Property

The Service, including its design, logos, trademarks, code, and documentation, is owned by WishPort and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

10. Termination

You may delete your account at any time through your account settings. Upon deletion, your wishlists, wishes, and personal data will be permanently removed in accordance with our Privacy Policy.

We may suspend or terminate your account at any time if you violate these Terms, engage in prohibited conduct, or if required by law. We will make reasonable efforts to notify you before termination, except where prohibited by law or where immediate action is necessary.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISHPORT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, WHETHER CAUSED BY TORT, BREACH OF CONTRACT, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICE.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the date at the top of this page and, where appropriate, by sending you a notification. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation or, if necessary, binding arbitration.
